Welcome to the Saints in Bloom website, saintsinbloom.com (the “Site”), and any related mobile application (the “App,” and together with the Site, the “Platform”).The Platform is operated by Saints in Bloom LLC (“Company,” “we,” “us,” or “our”). Each person who accesses and/or uses the Platform (each a “User,” “you,” or “your”) should read these Terms of Service (“Terms”) carefully before using the Platform. By accessing or using the Platform, you signify that you have read, understand, and agree to be bound by these Terms, whether or not you create an account. If you do not agree, please do not use the Platform.

TO THE EXTENT PERMITTED BY LAW, BY USING THE SERVICE, YOU AGREE TO ARBITRATE DISPUTES WITH US IN YOUR INDIVIDUAL CAPACITY AND WAIVE ANY RIGHT TO ACT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING. PLEASE REVIEW THE DISPUTE RESOLUTION SECTION BELOW FOR DETAILS.

All content on the Platform including text, images, graphics, logos, designs, and software is owned by or licensed to Saints in Bloom and is protected by copyright, trademark, and other laws. You may view and use the Platform for personal, non-commercial shopping. Any other use, including copying or distribution, requires our prior written consent.

5. Product Information and Returns

Products and prices may change without notice. We try to ensure accuracy but cannot guarantee that all product descriptions, photos, or pricing are free from error. Colors on your screen may differ from actual product colors. Our Return Policy, posted on the Platform, applies to all purchases.

6. User Content

If you post reviews, photos, or other materials (“Submissions”), you grant Saints in Bloom a worldwide, perpetual, irrevocable, royalty-free license to use, display, and distribute those Submissions in any media. You represent that your Submissions are your own and do not violate anyone else’s rights.

7. Prohibited Conduct

You agree not to:

  • Use the Platform for unlawful purposes.

  • Interfere with the operation of the Platform or attempt to access it in an unauthorized way.

  • Post content that is defamatory, obscene, infringing, or otherwise objectionable.

  • Use automated systems to scrape or collect data from the Platform.

10. Limitation of Liability

To the fullest extent permitted by law, Saints in Bloom and its affiliates will not be liable for any indirect, incidental, or consequential damages, or for any amount greater than the total you paid us for products in the 12 months before the claim arose.

You agree to indemnify and hold harmless Saints in Bloom, its officers, employees, and affiliates from any claims or demands arising from your use of the Platform or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Platform at any time, with or without notice, if we believe you have violated these Terms or for any reason we deem necessary.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law rules. Any dispute will first require written notice and a 30-day period to attempt resolution. If unresolved, disputes will be settled by binding arbitration on an individual basis in Maryland or via video conference, under the rules of the American Arbitration Association. You waive the right to a jury trial or to participate in a class action.
